Cannabis Promotional Product Rules Explained
Promotional products — branded lighters, rolling papers, grinders, trays, and similar items — are one of the most effective marketing channels for cannabis businesses precisely because traditional advertising is so restricted. But promotional products have their own set of rules. Most states prohibit distributing branded merchandise to anyone under 21 and ban designs that could appeal to minors.
Free cannabis product samples are prohibited in almost every recreational market (some medical programs allow limited samples to qualified patients). Branded merchandise that doesn't contain cannabis — like a custom lighter or rolling tray — can generally be sold or given to verified 21+ customers at licensed premises. Event distribution is trickier: most states require that any cannabis-related promotional activities at events meet the same audience age requirements as advertising.
